Senator Basescu: I'll call Romanians to protests if President is removed from nominating Prosecutors' Offices' heads

Senator Traian Basescu, chairman of the People's Movement Party (PMP) and former head of state said that the President of Romania should not be removed from nominating the Prosecutors' Offices' heads, adding that this will risk a "re-politicizing of the Judiciary" and that in this case, he will call the people to protest in the street.

"It would be a step back. The President must not be removed from nominating the heads of the Prosecutors' Offices, because there are a lot of other positions that are designated through presidential decree, not only the General Prosecutor, the DIICOT (Directorate for Investigating Organized Crime and Terrorism, ed.n.) Chief Prosecutor and the DNA (National Anticorruption Directorate, ed. n.) Chief Prosecutor, but also the deputies and the chiefs of Sections' Chief Prosecutors, through presidential decrees. About 30 such high prosecutors are to be nominated through presidential decree. Here stays a control between the President and the Government. The President can anytime tell the Justice Minister or the Prime Minister: "My dear, I understand you want to appoint prosecutor X, mind you that you are sending him/her in vain, he/she may get 50 thousands of positive opinions from the CSM (Superior Council of Magistracy, ed. n.), I'm not nominating him/her." And the President can say "here, there are three or four, see what you can propose, so I wouldn't send your decree back," Traian Basescu said at the private B1TV broadcaster, when asked about his opinion on the President's pulling off from the chief prosecutors' nomination.

He underscored that should the President is taken off from this chief prosecutors' nomination procedure, he will publicly ask the Romanians to take the streets in protests.

"The moment they will pull off the President, I'll go to a TV broadcaster, explain the Romanians how big the risk it is to have the Judiciary re-politicized and call them to protest. I'll be in front of the Parliament, at Kisellef (ruling Social Democratic Party's seat, ed. n.), at the Victoria Palace (gov't seat, ed. n.)," Basescu added.
